Court Decision Upholds Competitive Procurement Process and Validates State’s Selection of ModivCare as Non-Emergency Transportation (NET) Provider
August 5, 2026, PORTLAND, ME — The Maine Supreme Judicial Court has affirmed the State's contract award to ModivCare Solutions, LLC (or “ModivCare”) for Regions 2, 3, 4, and 8 non-emergency transportation (NET) brokerage services, upholding the decision of Maine's lower court and rejecting an appeal by Penquis Community Action Partners (Penquis CAP).
In 2023, the Maine Department of Health and Human Services (DHHS) awarded ModivCare non-emergency transportation (NET) service contracts for Region 2 - covering Washington and Hancock counties; Region 3 - covering Penobscot and Piscataquis counties; Region 4 - covering Kennebec and Somerset counties; and Region 8 - covering York County and parts of Oxford County, following a competitive Request for Proposal (RFP) process. Proposals were independently reviewed and scored by state evaluators based on the RFP criteria. ModivCare’s submission received the highest overall score and was determined to represent the best value to the State through a documented, data-driven evaluation process conducted by the Maine Department of Health and Human Services (DHHS).
